1. Agreement to these Terms

By accessing or using the Service you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, you must not use the Service. These Terms incorporate by reference our Privacy Policy and Acceptable Use Policy.

2. The Service

ExifGhost provides tools to view, edit, strip and create metadata profiles (such as EXIF date and time, location and GPS, device and camera settings, and other EXIF fields), to inspect image metadata, and to mark images as AI-generated, for digital images — including AI-generated images — together with optional image adjustments and batch processing with ZIP export. Image processing runs locally in your browser and your images are not uploaded to or stored on our servers — the only exception being the optional Certified C2PA marking, where an image is sent to our server over an encrypted connection, signed in memory and returned to you, then deleted immediately and never stored. The Service is provided on an “as is” and “as available” basis and may evolve, change, or be limited or discontinued in whole or in part at any time.

3. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) and have the legal capacity to enter into these Terms. By using the Service you represent that you meet these requirements.

4. Accounts

To use certain features you may need to create an account. You agree to provide accurate information, to keep your credentials secure, and to be responsible for all activity under your account. You may sign in through a third-party identity provider (currently Google), subject to that provider’s terms. You must notify us promptly of any unauthorised use of your account. You may delete your account at any time. If your account holds purchased credits, deletion deactivates it and starts a 30-day recovery window — logging back in within 30 days fully restores the account and its credits; after 30 days the account and any remaining credits are permanently deleted. An account with no credits is deleted immediately. In all cases, deletion does not entitle you to a refund of any purchased credits, except where a mandatory statutory right applies. To enforce free-tier limits and prevent abuse, a minimal, irreversibly hashed usage record may be retained for a short period as described in our Privacy Policy.

5. Plans, pricing & billing

The Service is currently in a pre-launch phase. The Free plan is fully available; paid credits are not yet purchasable and no payment can be taken at this time. The terms below describe how paid credits will operate once enabled, and apply only from the moment they are enabled.

The Service offers a Free plan plus optional pay-as-you-go credits. The Free plan includes a daily limit (currently 3 generated images per rolling 24 hours) and covers viewing, editing, cleaning and creating metadata, image adjustments, and a basic “Mark as AI” tag; the certified C2PA marker, and any images generated beyond the daily free limit, are paid with credits. We do not currently offer a subscription. We may introduce subscription plans in the future, in which case their recurring-billing, renewal and cancellation terms will be presented at checkout and apply only from when they are enabled.

Credits are bought once through our third-party payment processor, Stripe, added to your account balance, and spent per action (for example, a certified C2PA mark, or generating images beyond the daily free limit) at the rates shown in the app, which may change for future purchases. Card details are entered with and handled by Stripe; we do not store your full card number. Credits are tied to your account, are non-transferable, have no cash value, and — unless stated otherwise at purchase — do not expire while the Service remains available; new credits add to your existing balance. Plan limits (such as the daily image limit or batch sizes) form part of these Terms. Except where a mandatory statutory right applies, purchased credits are non-refundable, including once partly used. If you are a consumer in the EU/UK, you expressly request that the Service (a digital service supplied immediately) begins as soon as you purchase, and you acknowledge that once it has been provided you lose the statutory 14-day right of withdrawal for the part already supplied.

The optional Certified C2PA marker adds standardised, machine-readable Content Credentials (including a declaration that the image is AI-generated and a trusted timestamp) to a file you provide. It is a tool to help you mark your content: any legal obligation to disclose or label AI-generated or manipulated content rests with the person or entity that generates or deploys it, and you remain solely responsible for how you use a marked file. The credential is editable and removable like any metadata and is not, by itself, proof of authenticity, origin, ownership or integrity. During our pre-launch the signing certificate is issued by ExifGhost and we are actively seeking verification from an official certificate authority; until then some verifiers may show the issuer as “not yet trusted”. We do not warrant that using the marker satisfies any specific legal or regulatory requirement.

6. Acceptable use

Your use of the Service must comply at all times with our Acceptable Use Policy, which forms part of these Terms. Violations may result in suspension or termination and, where appropriate, reporting to the authorities.

7. Your content & responsibilities

You retain all rights you hold in the images and metadata you process with the Service (“Your Content”). We do not claim ownership of Your Content.

You are solely and fully responsible for Your Content and for how you use the Service. You represent and warrant that you have all rights, licences, permissions and consents necessary for the images and metadata you process — including the consent of any identifiable individuals whose face, likeness or personal data appear in those images, and including any applicable image, model-release or privacy rights.

ExifGhost is a neutral, automated tool and service provider. We do not pre-screen, review, moderate, endorse or control the images or metadata you create, and we are not the author, publisher or distributor of Your Content.

Disclaimer of misuse. ExifGhost provides only the technical means to view and edit image metadata and to apply optional image adjustments. The operator expressly disclaims any responsibility or liability for the manner in which users use the Service and for the content they create. You must use the Service only for lawful purposes and in compliance with all applicable laws, these Terms, our Acceptable Use Policy and the rights of others. Any unlawful, fraudulent, deceptive or infringing use is strictly prohibited, and you assume all risk and liability arising from your use of the Service and your content.

8. Metadata, authenticity and responsible use

The Service applies the metadata values and image adjustments selected by the user. ExifGhost does not verify, certify or guarantee that any metadata value is accurate, truthful, authentic or representative of the actual origin, location, date, device, authorship or integrity of any image.

Metadata is editable information and must not be relied upon as proof of authenticity, origin, ownership, capture location or capture time.

You must not use the Service to deceive, defraud, impersonate, mislead, evade verification systems, bypass platform rules, manipulate evidence, or misrepresent AI-generated or edited content as authentic real-world photography where doing so would be unlawful, deceptive or infringe the rights of others.

9. Intellectual property

The Service, including its software, design, text, graphics, the ExifGhost name and logo, and all related intellectual property, is owned by ExifGhost or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, reverse-engineer or create derivative works from the Service except as permitted by law.

10. Third-party services

The Service may rely on or link to third-party services (such as authentication, payment processing, hosting and fonts). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

12. Limitation of liability

To the maximum extent permitted by law, ExifGhost and its operator shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits, reputation or goodwill, arising out of or related to your use of (or inability to use) the Service or to Your Content. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or EUR 50. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

13. Indemnification

You agree to defend, indemnify and hold harmless ExifGhost and its operator from and against any claims, damages, liabilities, losses and expenses (including reasonable legal fees) arising out of or related to Your Content, your use or misuse of the Service, or your violation of these Terms, the Acceptable Use Policy or any law or third-party right.

14. Suspension & termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and without notice if we reasonably believe you have violated these Terms or the Acceptable Use Policy, or to protect the Service, other users or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination (e.g., ownership, disclaimers, liability, indemnity) will survive.

15. Governing law

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. Subject to any mandatory consumer-protection rights you may have in your country of residence, the courts of Italy shall have jurisdiction over any dispute arising from these Terms or the Service.

16. Changes to these Terms

We may modify these Terms from time to time. When we make material changes, we will update the “last updated” date and, where appropriate, provide further notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
